ECAD WILL BE CHARGED FOR COPYRIGHT SONGS PERFORMED IN SITES, BLOGS AND ONLINE RADIO
The controversial role of the Central Bureau of Collection and Distribution (ECAD) is of public spaces, festivals, nightclubs, radio and TV stations and reaches the virtual world. Among the targets are blogs, websites, web radios, TVs and web podcasts, which will have to pay an amount corresponding to the playing of music.
The executive manager of the entity's revenue, Márcio Fernandes, said that the recovery should start later this year. Who establishes the possibility is the law 9.610/98, which amended and updated the copyright law in 1998. And it also includes videos from Youtube, now the main means of disseminating music online. The Ecad and Google Brazil - the company is the owner of YouTube - are "exchanging drafts," said Fernandes, adding that there is a possibility that the two parties close a deal.
- The Ecad has won a lawsuit against the Kboing (Virtual Radio). We are charging when it is streaming the event, not the downloads - the manager explains, adding that analog radios to relay programming via the web will also have to pay.
The release of payment depend only on the initiative of the author to waive the payment by giving notice to an association of holders of rights that comprise the Ecad. So who owns the licensing mechanism known as Creative Commons - non-profit project that provides flexible licensing for intellectual works - must notify the office.
Legislation
The legal status of copyright has been the subject of much discussion and lobbying in political circles. The Ecad and associations that keep you argue that the current law is maintained. The Ministry of Culture supports the creation of a new law to replace the 1998. And in March, a group of artists, representatives of music and Ecad met with Senator Raymond Catarina Colombo (DEM) in Brasilia, to request the withdrawal of the bills of his own. The text of Columbus predicted changes in copyright law in order to avoid some users of music pay the copyright fee and reduce the amount charged for event organizers from 10% to 1% of gross revenues.
The impasse was not enough, the Ecad has been the target of complaints: two PICs - in Rio de Janeiro and Sao Paulo - there have investigated the performance and actions including the prosecutors questioning the lack of greater control over the actions of the entity. The executive manager, Márcio Fernandes admits that Ecad has been the target of criticism and investigations, but in his opinion, they occur because of the public receives little information about the performance and function. Therefore, the organization tries to change the table, betting on further dissemination of their work.
